Testosterone therapy is lawful in the United States when a licensed prescriber writes it for a medical purpose. The surprise is where testosterone lands in the law. It is a controlled substance, in the same schedule as ketamine and codeine combinations. So a TRT prescription works differently from a thyroid prescription. The differences are worth knowing before you book anything. Is TRT legal? Yes, with a prescription written for a medical purpose by a licensed prescriber. The Anabolic Steroid Control Act of 1990 placed testosterone and the other anabolic steroids into Schedule III of the Controlled Substances Act. The DEA lists it at 21 CFR 1308.13. Why is testosterone a controlled substance? Congress moved anabolic steroids into the schedules in 1990, after years of misuse in sport and bodybuilding. A schedule reflects the potential for misuse. It says nothing about whether a drug has a medical use. Schedule III is the tier for drugs with an accepted medical use and a moderate potential for dependence. Testosterone has a long list of approved medical uses, and it earns its place on both counts. What does the schedule change for you? Three practical things. None of that makes treatment harder to get. It does mean a clinic that hands out testosterone without labs and a diagnosis is one to walk away from. Is TRT the same as taking steroids? Prescribed testosterone and testosterone bought from a gym contact are the same molecule. The dose, the reason and the supervision are not. A clinic prescribing it works from bloodwork, a diagnosis and repeat labs while you are being treated. Misuse for muscle gain uses multiples of a treatment dose, without labs and without a prescriber. Can a clinic prescribe testosterone after an online visit? The Ryan Haight Act of 2008 requires an in person medical evaluation before a controlled substance is prescribed over the internet. The law includes telemedicine exceptions. Those exceptions were widened during the public health emergency and the deadline has moved more than once since. That is a moving target, so check what applies on the date you are treated.
